By using Embrk (the "Service"), you agree to these terms. If you do not agree, do not use the Service.
The Service
Embrk provides a staff app and web dashboard for yacht charter companies to manage their fleet and guest experience. We reserve the right to modify or discontinue the Service at any time with reasonable notice.
Your Account
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating an account.
- One account per company. You may not share access with other companies.
- You must be 18 or older to use the Service.
Acceptable Use
- Use the Service for any unlawful purpose.
- Upload content you do not have the right to use.
- Attempt to reverse engineer, hack, or disrupt the Service.
- Resell or sublicense the Service without our written consent.
Your Content
You retain ownership of all content you upload. By uploading content, you grant us a limited licence to store and display it within the Service on your behalf.
Payment
Subscription billing terms will be presented at the time of purchase. All fees are non-refundable unless required by law. We may change pricing with 30 days notice to active subscribers.
Termination
You may cancel your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.
Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee uptime, accuracy, or fitness for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, Embrk shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
Governing Law
These terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Valencia, Spain.
